Why use a lawyer rather than a conveyancer?
It is advisable to use a lawyer as opposed to a conveyancer to handle your conveyance as lawyers are able to perform ALL legal work associated with the transaction, whereas conveyancers are limited to only being able to assist you with “conveyancing work” and must refer you to a lawyer if the work goes beyond the scope of straightforward conveyancing work or involves issues which are too complicated for them to handle.

The Conveyancing Process
The conveyancing process can involve the following steps:

- Verifying your identity and obtaining the necessary authority to ensure that you have the authority to partake in the process
- Arranging pest and building inspections and Strata reports</span
- Arranging finance (if required)
- Reviewing the Contract of Sale
- Exchange of Contracts and payment of the deposit (usually 10% of the purchase price)
- Arranging payment of stamp duty
- Determining if any government authority (e.g Sydney Water, Local Council, RMS etc) has a vested interest in the land or if any planned development could affect the property
- Determining whether any important information about the property has not been disclosed e.g fencing disputes, illegal building works etc
- Calculating adjustments for council and water rates for the property settlement
- Completing any final searches and checks prior to settlement
- Overseeing the change of title with Land Registry Services (LRS)
- Representing you in the PEXA workspace to conduct an electronic settlement.
